In such matters, local authorities are not in a position to intervene, both for the sake of the separation of Church and State and because certain halakhic problems would arise. This situation leaves the woman in a state of aginut in which she is unable to remarry. To remedy this situation, the movement promotes a marriage contract in which the couple agrees to proceed with their divorce, in case it occurs, before a rabbinical court. There are several ways to challenge a marriage contract in court. These include a lack of volunteering, a lack of scruples and the non-transfer of assets.  Marriage contracts in all U.S. states may not regulate matters related to the children of marriage, particularly custody and right of residence issues.  The reason for this is that children`s issues must be decided in the best interests of the children.  However, this is controversial: some people believe that since custody disputes are often the worst part of a divorce, couples should be able to settle this in advance.  While a couple may enter into a marriage contract with the intention of resolving problems that may arise during their marriage, these agreements are generally intended to address the problems that will arise if the marriage breaks down. Marriage contracts are binding on the parties as they are the most legally binding. They can be enforced by the courts if someone tries to escape or change an obligation they have accepted.
